Ithaca Umpires Association Constitution
NFW YORK STATE BASEBALL UMPIRES ASSOCIATION Section 1. The name of this organization shall be the Ithaca Baseball Umpires Association. ARTICLE II. Purpose ARTICLE III. Officers and their Duties Section 1. The officers of the Association shall be a President, Vice President, Secretary, Treasurer, Rules Interpreter, and Assignor. The Treasurer will be a dual role assigned to either the Secretary or the Assignor. Each of the above elected officers shall hold office for two years. Section 2. The duties of the President shall be to preside at all meetings and maintain order therein. He shall sign all orders of the Secretary-Treasurer authorized by the Association, appoint all committees not provided for In the Constitution and By-Laws, and perform such duties as naturally fall to the President of an organization. The President shall not pay dues. He shall attend, or his designated representative shall attend, the NYSBUA annual meeting as a voting delegate of this chapter. Section 3. The duties of the Vice President shall be to perform the duties of the President when called upon by the President or if the President is unable to attend a meeting. He shall perform any such duties that naturally fall to the Vice President of an organization. Section 4. The duties of the Secretary shall be to keep an account of the minutes of all meetings, to send out notices of all special meetings to members and to take care of all correspondence. The secretary shall take attendance and keep a record of each member’s attendance at each meeting. The Secretary shall send a roster of all officials to schools that we service as soon as possible every year. The Secretary shall perform any such duties that naturally fall to the Secretary of an organization. The secretary shall not pay dues and the salary for this position shall be established prior to being elected, by recommendation of the Executive Committee and approved by the membership. Section 5. The Rules Interpreter shall attend NYSBUA rules interpretation meetings and, if possible, along with another Association officer. He shall be the final authority as to any playing rule which may be in dispute. He shall be in charge of all interpretation meetings, spring training sessions and clinics of this Association. He shall not pay dues. Section 6. The Assignor shall make all game assignments for the Association. He shall available at all regular meetings a master chart with all officials names and assignments recorded. Every game that is assigned through the Association will appear on the chart. A separate log will be kept reflecting all games and the officials assigned to those games. He will provide the Treasurer with a list of all games worked by each official, where appropriate the proper fee to be paid and the appropriate assessment per game if an assessment is required. He shall not pay dues and his salary shall be established prior to his election by recommendation of the Executive Committee and approved by the membership. Section 7. The Treasurer shall keep a full and accurate account of all money received and deposit same in the name of and to the credit of the Ithaca Baseball Umpires Association. The Treasurer shall present at each regular meeting a report of the treasury, collect all dues, and keep an accurate account of the members in good standing. The Treasurer shall have the books audited, on a yearly basis, by an auditing committee appointed by the President. ARTICLE IV. The Executive Board Section 1. The Executive Board shall consist of seven Association members: President Vice President *Secretary *Assignor Rules Interpreter Two(2) active members at large who shall be elected for a period of one year at the last meeting in the spring *The Treasurer's job will be combined with either the Secretary's or the Assignor's job. Section 2. Shall rule on umpire advancement from Probationary to Associate to Active when appropriate but usually at the end of one season to be effective at the beginning of the next. Section 3. Shall need five (5) members present to have a quorum which will all the Executive Board to transact business. Section 4. Shall set mandatory interpreter meetings, clinics, special non- active member meetings and other required meetings. They shall deal with exceptions as the circumstances warrant. Section 5. Shall recommend the annual dues and/or assessments for the coming season to the membership for approval. Section 6. Shall direct the financial administration of the Association and shall authorize the Secretary-Treasurer to make expenditures. Section 7. Shall direct the policy of the Association and receive complaints from the membership. Section 8. Shall recommend the salaries for the Secretary-Treasurer and Assignor to the membership prior to their election. The membership will vote approval or not of the recommended salaries. Section 9. Shall receive and act on alt written petitions for exception to any Article or Section of an Article in the Constitution Section 10. Shall determine penalties for members not fulfilling meeting requirements. Section 11. Shall determine the amount of the fines to be levied by the Sergeant-At-Arms if that position is appointed. Section 12. Shall rule on all transfer applications. Section 13. Shall rule on all Ethics violations. Section 14. Shall appoint three (3) active members to the Nominating Committee. Section 15. Shall have the right to recommend change of officiate for a championship game so as to offer the two schools involved two active officials. The replaced official(s) shall be given another assignment on that date whenever possible. Section 1. A quorum shall consist of one-third (1/3) of all members in good standing. Section 2. A minimum of eight (8) meetings a year are to be held with the first two scheduled before any assignments are given out. The schedule for all meetings shall be announced at the first meeting of the year. Section 3. Each member must attend a minimum of five (S) scheduled IBUA meetings plus one interpretation meeting to remain in good standing. The Executive Board will act in all cases where a member does not meet the requirement. Section 4. A Sergeant-At-Arms shall be an optional position appointed yearly by the President if deemed necessary. The Sergeant-At-Arms is empowered to levy fines set by the Executive Board on any member who is unruly or persists in carrying on private conversations while meetings are in process. Section 1. New members shall be given a written test compiled by the NYSBUA. To be accepted as a probationary member the new member must attain a mark set down by the State Association. Designated fees for the exam must be paid before taking the exam. Section 2. PROBATIONARY MEMBERS: All new members to the IBUA must serve at least one year as a probationary member. To qualify as a Probationer, the candidate must take and pass the written exam on baseball rules given once annually. A probationary member will not be assigned college or high school varsity games unless no active or associate members are available. Probationary members shall be assigned junior varsity, freshman, and junior high games. A probationary member be recommended by the Executive Board to sit for the NYSBUA written Rules Exam given annually in the fall. The probationary member who succeeds in gaining a mark of 75 or better in the exam will be advanced to the station of associate member. College and high school students shall remain as probationary members at all times. Section 3. ASSOCIATE MEMBERS shall retain the associate status for at least two seasons with this association. Their progress shall be observed and reviewed at the end of the second year as an associate member by the Executive Board. The Executive Board shall give final approval before the associate member can be granted active status. While holding the associate status no college assignments are to be given unless no active member is available. He may work high school varsity games when no active member is available. He will be given preference over probationary members for assignments to junior varsity, freshman, and junior high games. Section 4. ACTIVE MEMBERS: After an official has served successfully as a probationary and as an associate member he qualifies, with Executive Board approval, as an active member. He may accept all types of games both college and high school. During his probationary and associate status he must have met all the requirements of the Five Point Program set down by the State Association. Section 5. TRANSFER MEMBERS: If a member of another umpire association elects to transfer his membership to this Association, he must apply in writing to the Executive Board for status, as described above. The Executive Board will rule on his status. Section 6. INACTIVE MEMBERS: A member in good standing may become an inactive member by filing the appropriate form and paying the appropriate fee. He must pay one-half (1/2) of the regular dues each year he has inactive status. After a period of three (3) years, he must either come back as an active member or be dropped completely from the organization. Section 7. DUAL MEMBERS are IBUA members holding active membership in another baseball umpires association. Such members shall meet all IBUA rules including dues and meeting requirements. Section 8. HONORARY MEMBERS: The IBUA reserves the right to grant membership to deserving individuals who are not active officials. Section 9. DROPPING OR REINSTATEMENT: If any official drops out of, or is dropped by the Association, he must meet the following conditions to be reinstated: a. Take and PASS the Probationary Exam. b. Serve the necessary years to become an Active member. c. Pay alt dues, fees, and fines that are owed. ARTICLE VII. Dues and Assessments Section 1. Dues and/or assessments will be recommended by the Executive Board and approved by the membership by the third meeting of the year. Next season's dues must be paid by July 1 of the previous year. Failure to pay dues by July 1 will result in a $10 late fine to be paid before any further assignments are made. Section 1. All officials of the IBUA shall wear the required New York State Umpire uniform and have available to them all required equipment. All IBUA members shall wear the NYSBUA patch on the left sleeve. If a jacket is worn it shall have a NYSBUA patch on the left sleeve. The uniform should look neat at all times. Section 1. All officials are committed to their first assignment unless changed by the assignor. If an official cannot work a re-scheduled game, the newly assigned official has all priority rights of the game. Section 2. If an official has to remove himself from the game for any reason, the game shall be turned back to the Assignor. Changes are not to be made between officials. Section 3. No member shall represent this Association beyond the privileges and provisions of this Constitution in the affairs or administrative matters unless authorized by the Executive Board. Section 4. No member shall solicit games or communicate with coaches, managers, school or league directors for personal gain. Section 5. No member shall involve or obligate this Association in any indebtedness unless he is given explicit authorization by the Executive Board. Such infraction shall be considered a flagrant violation of the Association rules and regulations. Section 6. The Executive Board shall rule on any illegal, unethical, and/or inappropriate behavior such as: a. Failure to appear in time to start a game as scheduled as a result of a personal laxity or irresponsibility. b. Displaying contempt and/or disrespect toward a fellow official. c. Failure to maintain standard appearance regarding the uniform and equipment and neatness of both. d. Drinking alcoholic beverages before or during a game or appearing for a game under the influence of alcohol which shall be considered a flagrant violation. e. Wagering or gambling on any game, its course or its players which shall be considered a flagrant violation. f. Discussing or commenting on confidential administrative matters or other matters which may hurt the reputation of any of the membership with nonconcerned personnel outside this association. g. Any improper conduct while in uniform before and during the officiating of a game such as but not limited to smoking, using obscene language, mingling with or arguing with fans during a game. h. Deliberate failure to fulfill an accepted game assignment. FIRST OFFENSE: (In one < 1 > season) 1. A one year probation starting with the next season. 2. Fellow official, working atone, receives 1 and 1/2 game fee. (a) school pays one official's fee (b) offending official pays 1/2 game fee. SECOND OFFENSE:(in one <1> season) 1. Fellow official, working alone, receives 1 and 1/2 game fee. (a) School pays one official's fee (b) Offending official pays 1 full game fee (1) 1/2 to fellow official (2) 1/2 to our association 2. Offending official works a reduced schedule 3. Offending official receives no post season games THIRD OFFENSE: (in one < 1 > season) 1. Fellow official, working alone, receives 1 and 1/2 game fee. (a) School pays one official's fee (b) Offending official pays 1 and 1/2 game fee. (1) 1/2 to fellow official (2) 1 game fee to our association 2. One year suspension based on the time of the third offense: (a) If in the first half of the season the suspension will begin at once (b) If in the second half of the season the suspension will take effect the following season. 3. Suspended official may re-apply as a probationary official when the suspension period is complete. Section 7. A member of this Association shall not umpire any game that is not assigned by the Assignor of this Association; nor shall he umpire any game with non-members of this Association, unless approved by the Assignor or the Executive Board. Exception: Any member of this Association may umpire assigned College Baseball or Professional Baseball. ARTICLE X. Hearings of the Executive Board, Suspensions, and Penalties Section 1. The Executive Board shall have sole jurisdiction over alleged cases of misconduct committed by Association members. Section 2. HEARINGS/DUE PROCESS: a. The Association President, or an Executive Board member appointed by the Association President, shall preside over all hearings held to investigate the alleged misconduct of an Association member. A quorum of five (5) Executive Board members must be present for a hearing to take place. The accused Association member must be notified at least one calendar week (seven calendar days) in advance of the date, time, and place of any scheduled hearing. b. The accused will be provided with the charges and supporting evidence at the time of notification of the hearing. c. All of the concerned parties must be present at the hearing. These parties are: 1. The Executive Board, minimum of five (fi)including the presiding officer. 2. The accused. 3. The accuser if it is other than the Executive Board. 4. Witnesses where appropriate for both sides. 5. Legal council for either side if so desired. d. The hearing will be conducted as follows: 1. The presiding officer will convene the hearing on the designated date, time, and location. 2. The charges will be formally read to the accused and entered into the record. 3. The accused will have the opportunity to answer the charges. 4. The accused will have an opportunity to c |
